NOTICE OF CONFIRMATION OF AN ORDER HIGHWAYS ACT 1980 WILDLIFE AND COUNTRYSIDE ACT 1981
WORCESTERSHIRE COUNTY COUNCIL
FOOTPATH AN-510 (PART), FORMERLY FOOTPATH 5, IN THE PARISH OF ABBERTON
PUBLIC PATH DIVERSION ORDER AND DEFINITIVE MAP AND STATEMENT MODIFICATION ORDER 2017
On 7 December 2017 the County Council confirmed the above Order made under Section 119 of the Highways Act 1980. The effect of the Order as confirmed is to divert Public Footpath by:
Diverting the length and entire width of footpath AN-510 (part), in the Parish of Abberton, commencing at a stile at its junction with the unmetalled district road at Ordnance Survey grid ref SO 9955 5335 (point A on the Order map). The path proceeds in a generally south-westerly direction to a gate at Ordnance survey grid ref SO 9949 5321 (point D), continuing in a south-westerly, then southerly direction, to a pedestrian gate at Ordnance Survey grid ref SO 9936 5257 (point C on the Order map). The total distance of footpath to be diverted is 825 metres.
To a point commencing at a stile at its junction with the unmetalled district road at O.S. grid reference SO 9955 5335 (point A). The path proceeds in a generally southerly direction along a mown path with a width of 3 metres for a distance of 142 metres, to the gate at O.S. grid ref SO 9954 5321 (point B). The path then continues in a generally south-westerly direction across an open field at a width of 2 metres for a distance of 665 metres, to a gate at O.S. Grid Ref SO 9936 5257 (point C). As shown on the Order map. The total distance of the diverted footpath is 807 metres
A copy of the Order and the Order map have been placed and may be seen free of charge at County Hall, Spetchley Road, Worcester, and at Wychavon District Council, Evesham Community Contract Centre, Abbey Road, Evesham, Worcestershire, WR11 4SB on Mondays to Fridays during normal office hours. Copies of the Order and map may be bought at County Hall, Worcester at the price of £7.50.
The Order comes into force on 18 January 2018 but if a person aggrieved by the Order wants to question its validity, or that any provision contained in it, on the ground that it is not within the powers of the Highways Act 1980 as amended or on the ground that any requirement of the Act, as amended, or of any regulation made under the Act has not been complied with in relation to the Order, he or she may, under paragraph 2 of Schedule 2 to the Act as applied by paragraph 5 of Schedule 6 to the Act within 6 weeks from the date of this Notice make an application to the High Court.
