A MAN who attacked his mum with a baseball bat has been cleared of intending to cause her serious harm.

Samuel Green, aged 23, admitted wounding but denied wounding with intent and a jury at Worcester Crown Court found him not guilty of this charge. The case was adjourned for psychiatric reports and he is due to return for sentencing at a date to be fixed.

Paul Mytton, prosecuting, told the court Green was asleep in the former family home in Feckenham Road, Redditch, when his mother arrived to ask him to leave.

She said she was now the owner of the house after a family dispute and wanted to clear it out so that she could sell it to pay the mortgage on her own home.

She arrived at 9.30am on June 13 last year and there was an argument when she went to her son's bedroom. She asked him to help her in cleaning the house in preparation for the sale.

When she turned her back, she felt a hard blow on the head and fell to the ground. When she looked up at her son, he brought the bat down on her again and she injured her finger trying to protect herself. The bat broke but he showed no remorse.

Green's mother, Jayne Green, told the court that she had been awarded the property after a domestic dispute. Her husband, who was under a non-molestation order, had left the property. She understood that her son would be moving out that day but he showed no sign.

He said he was not working and had no money so he had nowhere to go. She offered a room to share at her house. She tried to remain calm but he got angry and said he was not leaving. She said she had no alternative as she had no money to pay the mortgage on her own home.

After she had been struck, blood poured down her face and over her clothing. She estimated he had hit her four or five times. He was very angry and said "I just want my family back".

Cross-examined by Martin Butterworth, defending, she described Green as a "loving boy" and she admitted that she had wanted to withdraw from the case. She wanted him to get help and felt the case would not benefit anyone.

Green is now living in Llys LLwysten, a village near Swansea.
